WARNING
You have just connected to the marocartisan website of the marocartisan Company. You must read carefully the following provisions as they constitute a contract establishing the general conditions of the products and services in the electronic catalog (or store) of the marocartisan Company. The "click" you will execute after filling out your order form constitutes validation of your order and will constitute irrevocable acceptance of these general conditions. Consequently, you can only order products or services if you accept the conditions set forth below.
Preamble
The following general conditions of sale govern all transactions made on the marocartisan web catalog. Any order placed on this site implies the customer's unconditional and irrevocable acceptance of these conditions.
Purpose
This contract is a distance contract that aims to define the rights and obligations of the parties in the context of the sale of products by the marocartisan company on the Internet through the secure online payment platform of the Interbank Monetary Center.
marocartisan is a service and a registered trademark of marocartisan.
Definitions
In the following contract, each of the expressions mentioned above will be understood in the sense of its definition, namely:
- “Distance Contract”: any contract concerning goods or services between the marocartisan Company and a Consumer within a system of distance selling or service provision organized by the marocartisan Company, which for this contract uses exclusively the Internet network up to the conclusion of the contract, including the conclusion of the contract itself.
- “Consumer”: any natural person who in this contract acts for purposes that do not fall within the framework of their professional activity.
- “Order Form”: a document that indicates the characteristics of the Products ordered by the Consumer and which must be signed by them by "double click" to engage them.
- “Order”: the act by which the Consumer commits to purchase Products and the marocartisan Company commits to deliver them.
Product
All products listed in the catalog are sold until stocks are exhausted. The marocartisan Company reserves the right to withdraw an item from the catalog without prior notice. It cannot be held liable for compensating or canceling an order due to the inability to use the purchased product for reasons of incompatibility with equipment already owned by the buyer.
Placing an Order
After finding the product(s) you are interested in, click on the "order" button; the product is then added to your order form. You can modify your order form at any time and return to the catalog by pressing "continue shopping." When you have finished shopping, validate your order by clicking on the "pay" button.
In case of an error on your part when entering your order form, we advise you to send us a cancellation request by email within 24 hours. After cancellation of the order by marocartisan, you may order again.
Price
The prices listed in the catalog are indicated in Moroccan dirhams excluding tax and are valid at the time of consultation by the customer. They are the prices in effect at the time of the order. VAT is calculated in the order form based on the applicable rate on the day of the order. The order form and transactions are conducted in Moroccan dirhams. Any change in the rate will be automatically reflected in the prices of the products.
Order Execution
The order will be executed at the latest within 7 days from the day following the Consumer's order. In case of unavailability of the ordered Product, the Consumer will be informed as soon as possible and will have the option to cancel their order. They may then choose to request either a refund of the amounts paid within thirty days at the latest from their payment, or the exchange of the Product.
Delivery
Delivery is not ensured by marocartisan. The customer will collect their merchandise at the delivery address indicated on their Order Form. Products are delivered to the address specified by the Consumer on the Order Form. The Consumer is required to check the merchandise upon delivery and report any damage caused by the carrier on the delivery slip as well as to the marocartisan Company within one day.
Upon request, the Consumer can obtain an invoice sent to the delivery address by validating the option provided for this purpose on the Order Form.
Payment Method
To pay for your order, you choose the payment method among those offered by marocartisan on the payment page. In this case, the transaction for debiting your account is made on the day following the delivery confirmation date.
Your online payments are secured by the Interbank Monetary Center (CMI), which offers a fully secure payment service.
The Consumer guarantees the marocartisan Company that they have any necessary authorizations to use the payment method chosen by them when validating the Order Form. In case of payment by credit card, the provisions regarding fraudulent use of the payment method provided in the agreements concluded between the Consumer and the card issuer and between the marocartisan Company and its bank apply.
Data Confidentiality
The information requested from you is necessary for processing your order and is treated confidentially. You have a right to rectify your data.
Canceling an Order Paid by Credit Card
Right of Withdrawal
From the date of delivery of your order, you have a period of 7 days to exercise your right of withdrawal and receive a full refund. The costs of returning the goods will remain your responsibility. However, only goods returned in perfect resale condition, complete, and in their original (unopened) packaging will be eligible for a refund.
Warranty
All products sold in the catalog are guaranteed against manufacturing defects and material defects. The duration of this warranty is at least one year (from the date of the invoice). In case of return of equipment found not to be defective, transportation and handling fees may be charged to the customer. This warranty does not cover damages resulting from accidents, misuse, or negligence.
Proof of Transactions Paid by Credit Card
The data recorded by the CMI on the online payment platform for the account of marocartisan constitutes proof of the commercial transactions conducted between you and the marocartisan Company.
Force Majeure
marocartisan is only liable for the performance of its obligations to the extent that no event of force majeure prevents them.
